Might make the victim's families feel all warm and fuzzy, but suing the manufacturer of anything that someone bought and misused is ridiculous. Only because it didnt have to do with the rifle itself, but rather Remingtons advertising so the FOPA doesnt apply . It's still an utterly moronic lawsuit because Remington never encouraged murder and the gunman didnt even own the rifle, he stole it from his mother after he killed her. What he did is not the fault of Remington or their advertising. Lower courts should have thrown it out for being frivolous but I imagine theyve let their personal opinion of gun manufacturers get in the way. This is more of a first amendment issue than a 2nd.
Remington didnt do anything illegal or wrong, this is a very dangerous case for free speech if the plaintiffs succeed, because basically that would be mean that you can be punished for not actually breaking any laws. Regardless of your views on guns and manufacturers, This would be a terrible precedent to set.
